On 26 May 2011, the E.U. issued a new directive about setting cookies on websites.
Whilst the intention seemed to be to make websites operated (or hosted) in the E.U. ask for user confirmation PRIOR to setting cookies that could be used to gather personal information or that were used for any sort of analytical tracking purposes, the E.U. left it to the individual member state governments to actually write their own legislation. To date, very few governments have actually passed any legislation into law, and those that have, have interpreted the intention of the E.U. in widely varying degrees. From what I can see, eSyndiCat sets NO cookies that are used for any sort of tracking, or contain any personally identifiable data. Google Maps and Google Search, however , also sets at least one cookie each, and it is very unclear what Google uses the information for. And, of course, if you use Google Analytics you may have a variety of cookies set that probably are used for tracking and behavioural analysis. I can only recommend that website operators that are either in the E.U., or host their websites inside the E.U., research the subject from their own perspective, and apply any measures that they might need to comply with the legislation. If in doubt, consult a competent lawyer who is up-to-date in I.T. Law. |

That is not stricktly true jassmee
Many sites have both a Privacy Policy page and a Terms & Conditions page. Briefly: Terms & Conditions: This normally applies to those aspects relating to the trading/commercial policy of the site/company as a legal entity in relation to any customers or potential customers who transact with them via the site/internet. (i.e. their responsibiltes as a supplier, your resposibilies as a customer, delivery factors, and what happens in case something goes wrong, even to the extent of stipulating which country's laws will apply in the event of litigation to settle a dispute) A prenuptual agreement is a good example ![]() Privacy Policy: Deals with whether the site collects any information, by whatever means, from visitors to their site, whether they are an existing customer for which they already hold details, a visitor who interacts with the site in some other way, or whether they visited the site for just 30 seconds. It partcularly appertains to the collectiion of any personally identifiable information which they acquire directly with the visitors knowledge or indirectly without their knowledge. It should indicate what type of information it collects, how it collects it, and what it does with that information. In short, how and whether the site complies with any Data Protection laws that may apply. One of the main ways in which a site can collect information indirectly is via certain types of cookies. So the question of cookies are very much a part of any sites' online Privacy Policy, particularly at present in lite of the new EU laws, to sites that operate in the EU or any sites outside the EU that trade with anyone in the EU.
